ARE YOU SURE YOU KNOW HOW TO VERIFY A LAND TITLE DOCUMENT?


Land verification is critical and important in real estate transactions; if a person buys a land without adequate verification, he or she may end up in a big mess and lose both money and property.


What exactly is land verification?


Land verification is a process in which all matters concerning possession, ownership, or rights conveyed in land are verified and recorded with the government in order to provide evidence of title and prevent illegal property ownership.





Every real estate transaction must include the following documents: Excision, Gazette, Certificate of Occupancy, Deed of Assignment, Governor Consent, and Receipt are the terms. This document, however, cannot be substituted. If one document cannot be substituted for another, a real estate owner must have all of the documents and each of the documents must be verified by an expert.

However, it is critical that each of these documents be explained in greater detail for a better understanding.


EXCISION: Excision is the process by which the government releases a portion of uncommitted land. When the government acquires land and there is later Excision, it means that the property is no longer subject to government acquisition and that a certificate of occupancy can be easily obtained on such property.


GAZETTE: A gazette is the most perplexing document that non-land experts have ever heard of and know nothing about. They have no idea what it looks like or what its perceived advantages and disadvantages are. However is one of the most important documents you must be connected to so as avoid demolishing of property in future for not being associated with it.



The Gazette will list the communities or villages that have been granted excision, as well as the number of acres of land that the government has allocated to them in the future.


A gazzette document is one that keeps track of the locations or areas that the government has acquired or given to a community or family.


ASSIGNMENT DEED: a legal agreement to transfer an asset or sell a debt to someone else. It allows the current owner of a landed property to transfer ownership to another person.


GOVERNMENT CONSENT: This is the required approval. given by a governor of a state or his delegate in any transaction involving the transfer of ownership or interest in land or property in order to make the transaction legal


There are procedures that must be followed in order for a land to be granted a Governor's Consent title. You must confirm that they were legitimately followed and that the required documents used to process the title were all authentic:


a. Certified True Copy (CTC) of the title's root


b. Transfer Deed/Instruments


c. Survey strategy


d. The applicants' letters of authority


e. Photographs of the site with dates


RECEIPT: Is a document that acknowledges that a person has received property payment as a result of the sale of property. There are procedures that must be followed in order for a land to be granted a Governor's Consent title.


The best way to determine whether the land has an excision that has been covered by a gazette is to have a credible surveyor chart the site and take it to the surveyor general's office to confirm whether it falls within the gazette and spell out the exact location where the land can be found.


What to do to avoid falling into the hands of a con artist:


1. Use an experienced real estate and property lawyer to verify title to land in order to avoid being duped by fraudsters.


2. Request a copy of the survey plan and have the Surveyor assist you in cross-checking it with the original. By charting the land, coordinates can be obtained.


3. Request the excision file number of the intended land in order to determine whether or not the land is available.


4. Do not rush to make a payment, especially if the price of the land is extremely low.




HOW TO VERIFY A SURVEY PLAN'S AUTHENTICITY AND GENUINENESS


The following information must be present to confirm the authenticity of a survey plan:


1. The name of the landowner whose land was surveyed.


2. The size of the surveyed land.


3. The address/description of the surveyed land.


4. A stamp indicating whether or not the land is subject to government acquisition.


5. The surveyor who drew the survey plan's name.


6. Date the survey plan was created.


7. The portion of the land survey that has been drawn out and mapped out on the survey document.


One thing to keep in mind is to hire a reputable surveyor to accompany you to the exact land site to ensure that the coordinates on the survey plan match the actual coordinates.
